1. General
These Terms of Use apply to the use of websites and digital services provided by SSAB AB or other legal entities belonging to SSAB Group (hereinafter "SSAB") that are made available at SSAB websites, mobile applications and other digital platforms from time to time, such as eCommerce, MySSAB portal, calculators and other applications (hereinafter “Services”). Some digital services and applications made available by SSAB may be subject to specific terms and conditions which prevail over these Terms of Use in case of discrepancies.
These Terms of Use apply to the relationship between SSAB and the users of the Services as well as the organizations they represent. “User” means the individual user accessing and using the Services as well as the legal entities and organizations on behalf of which the individual user acts in connection with the use of Services. The individual user confirms that they have the legal right to represent their legal entity or organization when accepting these Terms of Use.
The use of Services requires an acceptance of these Terms of Use, either by explicit confirmation or implicitly by using the Services, and sometimes requires a registration as a User of the Services and/or payment of a license fee.
SSAB reserves the right to amend and/or supplement these Terms of Use as it may deem appropriate. In case of any such change, the User shall be deemed to have accepted the new version upon continuing the use of the Services. With respect to some Services, the User may be required to approve the new version of these Terms of Use upon next login, renewal of registration or by other means required by SSAB.. . SSAB reserves the right to define which Services are available at any given time to the User. SSAB also reserves the right to amend and modify the Services and any of their features from time to time.
In addition to these Terms of Use, specific contract terms and conditions shall apply to the order and purchase of SSAB products and services transacted through eCom or otherwise. In case these Terms of Use conflict with any transaction terms concluded between SSAB and the User, the transaction terms shall prevail. In such case, these Terms of Use shall apply to the extent that they do not conflict with the terms of a particular transaction.
The Services may contain links to other websites. SSAB assumes no liability for any content created, owned or published by third parties that SSAB’s Services may link to nor does SSAB endorse or recommend the content, products or service of such third parties.
The Services and any information therein is only applicable to SSAB’s products. The Services or any of their content/information must not be applied to or used for design of any other products than original SSAB products.
2. Services Access; Use of Passwords
Access to some Services may require a personal user ID and a personal password (user ID and password collectively hereinafter "Passwords") unless the specific service is made available by SSAB freely without the use of passwords and user ID. SSAB shall deliver the Passwords to the User’s named email address after the registration and other potentially required information is submitted and checked. The User undertakes to promptly notify SSAB of any changes in the information submitted during the registration, e.g. when the employment of a person named as an authorized user expires or is terminated. The User shall be responsible in full for any use of the Services with the User‘s Passwords and any costs and damage caused thereby.
The User shall keep its Passwords strictly confidential and shall supervise and ensure that the Passwords are not given to any third parties or used by any unauthorized person. The User shall promptly notify any unauthorised use of Services, loss of Passwords or any other security jeopardizing event to its predetermined contact person at SSAB.
User is not entitled to give third parties access to the Services, especially by distributing, transmitting, presenting or displaying it publicly without the prior written consent of SSAB or other right holders.
SSAB takes no liability that the User‘s Passwords are in possession of right persons. The responsibility thereof lies with the User. If the Passwords are correctly given when entering to the Services, SSAB has no obligation to verify the Service enterer’s identity or its right to represent the User in any other way.
After the User has notified SSAB of unauthorised use or loss of its Passwords or some other breach of security, SSAB shall terminate the user rights and/or close the Services with respect to such Passwords. After such termination and/or closure, the Services cannot be used with the Passwords.
3. System Integrity
Services are accessible via various terminal equipment and availability, features or design may vary with respect to the terminal equipment used.
The User is responsible for the technical functionality of the hardware, software and data communication services used by it to access the Services. The User shall not use any device, software or routine containing viruses or otherwise intended to damage, interrupt or interfere with the proper function of the Services. The User shall neither use any device, software or routine, which purpose is to surreptitiously intercept or expropriate data or personal information from the Services or copy its systems.
The User may not take any action which imposes an unreasonable or disproportionately loads SSAB‘s infrastructure, including but not limited to "spam" or other such unsolicited mass e-mailing techniques.
If the User jeopardizes or breaches the system integrity, the User compensates SSAB the incurred damages, including but not limited to special, incidental, consequential, direct or indirect damages, in full. SSAB is not responsible for any damage caused by misuse or mishandling of system.
4. Product Orders, Terms of Sale in eCommerce
These Terms of Use also apply to the use of SSAB’s eCommerce platform. A contract for the supply of products shall be concluded on SSABs eCommerce platform when the following conditions are met cumulatively:
- correct User login to the portal
- placing orders for certain products
- SSAB confirms the order electronically under the conditions specified in the order confirmation.
The General Conditions, ALBIF 2000, for Delivery of Iron and Steel Products etc shall apply to the supply of products, to the extent they do not contradict with what has been agreed in writing or electronically between SSAB and the customer entity the User represents.
5. Data Processing and Protection of Privacy
SSAB may process personal data of the Users in connection with the use of the Services, such as the following: name, email address, company that the User represents, approximate location data of IP address, if applicable and other possible personal data submitted voluntarily by the User or gathered during the use of the Services. If personal data is transferred through Services, the User shall be responsible for ensuring that it has the right or it has obtained necessary consents for the transfer of such personal data to SSAB for the purposes of the Services.

6. User’s Content
“User’s Content” means content submitted by the User to the Services such as company-related or business and production information, as well as information collected from the User through the Services or during the use thereof. The User retains ownership of any pre-owned Intellectual Property Rights to the material that it submits to the Services.
User hereby grants SSAB the perpetual, irrevocable, non-exclusive, transferable, fully-paid, royalty-free and worldwide right to collect, access, store, retain, download, modify and otherwise use User’s Content in order to
-provide and operate the Services, including but not limited to trouble shooting, maintenance, supporting Users, optimizations and improvements as well as for system integrity and data security purposes.
-for the management of business relationship between User and SSAB and in order to provide and improve services and product offering for the User
-for developing and improving the Services as well as future services, and to improve and develop SSAB’s product offering.
The User warrants that it will not submit any material or content to the Services that is protected by third party Intellectual Property Rights or that is not lawful.
User agrees to indemnify SSAB in case of any third party takes action against SSAB in relation to the content submitted by the User to the Services.
7. Confidentiality
The content and information made available to the User in the Services may contain SSAB’s business secrets and confidential information, such as technical or commercial information or data related to SSAB’s production and operations, business plans, financial information, non-public product information, designs and drawings, to the extent such information is marked as confidential or should be reasonably understood to be of confidential nature (hereafter “Confidential Information”).
The User shall treat as strictly confidential any Confidential Information, whether electronic data, paper prints or in any other form, disclosed to the User in the Services or in connection with the use thereof. The User shall not disclose to third parties or use Confidential Information, nor have it disclosed or used, directly or indirectly otherwise than for the purpose of the use of the Services.
Confidential Information shall exclude information which:
a) at the time of disclosure is generally known or in public domain or is otherwise generally accessible without restriction.
b) becomes public other than by breach of these Terms of Use or other contractual obligations of the Users
c) was in the possession without confidentiality restriction of the User prior to its disclosure by SSAB.
d) is rightfully acquired by the recipient from third parties provided that such information was lawfully in possession of said third party.
The User ensures that others, who have or may have access to confidential information, are aware of confidentiality and they are under obligation to be bound thereof. The User is responsible to take necessary steps to maintain the confidentiality.
8. Intellectual Property Rights
SSAB owns all Intellectual Property Rights in the Services and its contents. Intellectual Property Rights means any patents, rights of patent, copyrights, trademarks, trade names, copyrights, inventions, design patents, trade secrets, know-how and/or any other intellectual and/or industrial property rights, and applications thereof. All rights reserved.
9. Limitation of Liability
SSAB DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES AND CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USABILITY IN CONNECTION WITH THE SERVICES. WITHOUT LIMITING THE FOREGOING, SSAB DOES NOT PROVIDE ANY WARRANTY THAT THE SERVICES WILL BE FREE FROM ERRORS OR INTERRUPTION. SSAB SHALL NOT BE LIABLE FOR ANY KIND OF DAMAGES AND/OR COSTS ARISING THEREFROM, WHETHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SERVICES OR THE CONTENT, INFORMATION OR RESULTS INCLUDED IN THE SERVICES, INCLUDING BUT NOT LIMITED TO THE LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS OR LOST SALES EVEN IF SSAB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES (COLLECTIVELY HEREINAFTER "DAMAGES"). THE SERVICES AND ANY CONTENT, INFORMATION OR RESULTS OF THE SERVICES ARE PROVIDED “AS IS”.
THE USER AGREES THAT NEITHER SSAB NOR ANY OFFICER, AFFILIATE, DIRECTOR, SHAREHOLDER, AGENT OR EMPLOYEE OR ANY ENTITY OF SSAB SHALL BE LIABLE TO THE USER OR ANY THIRD PARTY FOR DAMAGES RESULTING DIRECTLY OR INDIRECTLY FROM OR OTHERWISE ARISING FROM OR IN CONNECTION WITH IN PARTICULAR ANY OF THE FOLLOWING:
A) SSAB PREVENTS, FOR ANY REASON WHATSOEVER, THE USER TO GET INTO THE DEFINED SERVICES
B) THE INFORMATION OR RESULTS PROVIDED IN/BY OR RELATED TO THE SERVICES ARE FALSE, ERRONEOUS, INACCURATE OR DEFECTIVE;
C) THE INTERRUPTION, SUSPENSION OR TERMINATION OF THE SERVICES FOR WHATEVER REASON
D) THE USE OF THE SERVICES AND THE CONTENT BY THE USER, INCLUDING DAMAGES RESULTING FROM OR ARISING FROM SUCH USER'S RELIANCE ON THE SERVICES OR ANY MISTAKES, OMISSIONS, ERRORS, DEFECTS OR DELAYS IN OPERATION, NON-DELIVERIES, MISS-DELIVERIES, OR ANY FAILURE OF PERFORMANCE ON THE SERVICES.
E) ANY UNAUTHORIZED PERSON'S OBTAINING AND/OR USING THE PASSWORDS OF USER; OR
F) ANY ALLEGATION, SUIT, CLAIM OR OTHER PROCEEDING BASED UPON A CONTENTION THAT THE USE OF THE SERVICES AND THE CONTENT BY USER INFRINGES INTELLECTUAL PROPERTY RIGHTS OR CONTRACTUAL RIGHTS OF ANY THIRD PARTY.
USERS AGREE THAT THEIR ACCESS OR USE OF THE SERVICES IS AT THEIR OWN DISCRETION AND RISK AND THAT USERS WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES THAT RESULTS FROM ACCESS OR USE OF THE SERVICES.
The Parties' liability as to specific agreements shall be contained in such agreements and the terms and conditions relating thereto.
10. Termination of the Use
Either SSAB or the User may terminate the use of the Services at any time. Neither party shall have any liability of any kind for any compensation of such termination. Upon termination, the User will lose the right to access to the defined Services.
11. Applicable Law and Arbitration
These Terms of Use and the Services are governed and constructed in accordance of the laws of Sweden. Disputes arising of or related to these Terms of Use and the Services shall be finally settled by arbitration according to the rules of the Arbitration Institute of the Stockholm Chamber of Commerce. Arbitration proceedings shall take place in Stockholm, Sweden. The language of the arbitration shall be English.
